Definition:
Ein Familienfideikommiss ist ein durch privates Rechtsgeschäft gebundenes Sondervermögen, das grundsätzlich unveräußerlich und unbelastbar ist, von bestimmten Familienmitgliedern nacheinander in einer von vornherein festgelegten Folgeordnung genutzt wird und dazu bestimmt ist, die wirtschaftliche Kraft und das soziale Ansehen einer Familie dauernd zu erhalten. Die Fideikommisse verdanken ihre Entstehung dem Wunsch der grundbesitzenden Familien, insbesondere des Adels, ihren Besitzstand geschlossen zu erhalten.
Erbrechtlich ist ein Familienfideikommiss eine Anordnung des Erblassers, nach der das Eigentum an seinem Nachlass in Obereigentum und Nutzungseigentum aufgespalten werden sollte. Dabei wurde einer Person eine Art Nießbrauch an dem Nachlass eingeräumt. Der Familie als ganzer blieb zum Erhalt des Familieneigentums aber das Obereigentum am Nachlass.
Sozialgeschichtliche Bedeutung
Die Familienfideikommisse wurden zum Erhalt des Familienvermögens adeliger Familien über Generationen hinweg eingesetzt. Schlösser, Burgen und Herrensitze mit den dazugehörigen land- und forstwirtschaftlichen Betrieben waren oft in den Familienfideikommissen gebunden. Sie diente vor allem auch dazu, adelige Söhne, die schlecht besoldete, aber prestigeträchtige und einflussreiche Ämter in Staat und Heer einnahmen, finanziell aus dem Familienvermögen zu versorgen. Im 19. Jahrhundert gerieten die Familienfideikommisse in die Kritik, weil sie durch das sie betreffende Verfügungsverbot nicht am Güteraustausch teilhaben konnten und damit das Wachstum des Sozialproduktes bremsten. Da sie auch einem Belastungsverbot unterlagen, konnten sie ebenfalls nicht als Realkreditsicherheiten eingesetzt werden. Auch behinderte das Belastungsverbot die wirtschaftliche Bewegungsfreiheit. Ferner wurden die Familienfideikommisse als Sonderrecht des Adels kritisiert. Zudem wurden die Familienfideikommisse auch in Ansehung der Eigentumsfreiheit als eine zu starke Einschränkung empfunden. Durch die Familienfideikommisse konnte die „kalte Hand“ des Erblassers über Generationen hinweg das Schicksal des Eigentums ohne Mitwirkung der das Eigentum innehaltende Familie lenken.
